In March 2010, legislation was passed which considered over-the-counter medicine and drug expenses not eligible for reimbursement under a Medical Reimbursement Plan without a prescription or letter of medical necessity from the provider. “Reimbursement for expenses incurred for a medicine or drug shall be treated as a reimbursement for medical expenses only if such medicine or drug is a prescribed drug (determined without regard to whether such drug is available without a prescription) or is insulin.”
If you currently use the Take Care benefit card, it will no longer work for over-the-counter medicines and drugs effective January 1, 2011. You must submit the receipt with the claim form and prescription or letter of medical necessity from your provider to EBS. Please consider these new regulations when enrolling and estimating your 2011 FSA election.
